Contiguity Fast Track Terms

These Fast Track Terms supplement the Contiguity Services Agreement and the Contiguity Number Leasing Terms and apply when you enable Fast Track on one or more leased numbers. By enabling Fast Track, you agree to these Fast Track Terms in addition to all other applicable terms.
1. Fast Track Generally
1.1 What's Fast Track
Fast Track is an optional, opt-in feature available through the Contiguity API, effective February 26, 2026. Fast Track allows you to send API requests to a leased number without the standard rate limiting and protective safeguards that Contiguity otherwise enforces.
1.2 Standard Protections Bypassed
By default, Contiguity enforces the following protections on all leased numbers:
(a) API-level rate limiting — platform-wide request rate limits applied across your account;
(b) Number-level rate limiting — per-number request rate limits; and
(c) Sending recommendations — automated best practices and guidance regarding message pacing, throughput, and sending behavior.
When Fast Track is enabled on a number, all three protections listed above are bypassed for that number. Contiguity will fulfill Fast Track requests without applying these safeguards.
1.3 Enablement; Per-Account Agreement; Per-Request Use
Fast Track is not enabled by default. To enable Fast Track for your account, you must affirmatively agree to these Fast Track Terms by submitting a POST request to the Fast Track entitlements endpoint, as described in the Contiguity API documentation. Agreement is required once per account and constitutes your binding acceptance of these Fast Track Terms on behalf of yourself or the entity you represent.
Once enabled at the account level, Fast Track may be invoked on a per-request, per-number basis by providing the fast_track parameter at the time of each applicable API request. Contiguity does not apply Fast Track to any request that does not include this parameter, regardless of your account's enablement status.
2. Your Responsibilities
2.1 Assumption of Risk
By enabling Fast Track, you acknowledge that Contiguity's standard protections exist to preserve number health, deliverability, and carrier reputation — and that by bypassing them, you assume full responsibility for managing your own request volume, pacing, and throughput in a manner consistent with carrier policies and industry best practices.
2.2 Compliance
Your use of Fast Track must comply with:
(a) These Fast Track Terms;
(b) The Contiguity Number Leasing Terms, including Sections 5 and 6;
(c) The Contiguity Communications Services Product Terms, including the Acceptable Use Policy;
(d) All other applicable provisions of the Contiguity Services Agreement;
(e) Carrier policies and industry standards (including CTIA Messaging Principles and Best Practices); and
(f) All applicable laws and regulations (including TCPA, CAN-SPAM, GDPR, and other privacy and communications laws).
2.3 Monitoring Your Numbers
You are responsible for monitoring the health, deliverability, and reputation of any number on which Fast Track is enabled, and for promptly addressing any issues that arise.
3. Disclaimer of Liability
3.1 Full Disclaimer
To the fullest extent permitted by applicable law, Contiguity disclaims all liability for any damage, loss, or harm to a leased number, its reputation, its deliverability, or its ability to send or receive messages, arising out of or related to your use of Fast Track. This disclaimer applies regardless of cause, including your negligence, error, misconfiguration, or intentional use of Fast Track, and supplements the disclaimers in Section 11 of the General Terms.
3.2 What This Covers
Without limiting Section 3.1, Contiguity is not liable for:
(a) degradation or permanent loss of a leased number's ability to send or receive messages;
(b) reduction in deliverability rates, filtering, or blacklisting of a leased number by carriers, Apple, Meta, or any other platform or network operator;
(c) damage to the reputation of a leased number with carriers, Apple, Meta, aggregators, or downstream networks;
(d) suspension, termination, or non-renewal of a leased number or associated platform access by Contiguity, the underlying carrier, Apple, Meta, or any other platform or network operator; or
(e) any regulatory, legal, carrier-imposed, or platform-imposed consequences resulting from sending patterns enabled by Fast Track.
3.3 Covered Replacements
Damage to a leased number resulting from your use of Fast Track will not qualify as a Covered Replacement under Section 5.3 of the Contiguity Number Leasing Terms. Numbers damaged through Fast Track use are subject to non-covered replacement terms only, and standard setup fees will apply.
3.4 No Warranties
Contiguity makes no representations or warranties that Fast Track is suitable for your use case, that numbers used with Fast Track will remain in good standing with carriers, or that high-throughput sending enabled by Fast Track will be delivered or accepted.
4. Negligent Use and Enforcement
4.1 Negligent Use
Notwithstanding the disclaimer in Section 3, your use of Fast Track must not be negligent. Negligent Use means sending patterns that a reasonable operator would recognize as likely to cause material harm to a number's health or reputation with carriers, Apple, Meta, or any other platform or network operator — for example, sustained sending at or above approximately 10 requests per second per number, or equivalent throughput patterns, without a legitimate operational justification. This example is illustrative and not exhaustive; Contiguity will assess Negligent Use based on the totality of the circumstances.
4.2 Enforcement
If Contiguity, in its sole discretion, determines that you have engaged in Negligent Use of Fast Track, Contiguity may, without prior notice, take any one or more of the following actions:
(a) impose a monetary fine or penalty on your account;
(b) suspend or permanently disable Fast Track for the affected number or your entire account;
(c) decline to renew, or immediately terminate, the lease on the affected number; or
(d) take any other action permitted under the Contiguity Services Agreement, including those under Section 5.2 of the General Terms.
4.3 Relationship to Leasing Terms
A finding of Negligent Use under these Fast Track Terms also constitutes a breach of Section 5.5 of the Contiguity Number Leasing Terms and may trigger the consequences set forth therein, including ineligibility for Covered Replacements and denial of future number leases.
5. Fees and Billing
5.1 Fast Track Fee
Fast Track may be subject to a monthly fee ("Fast Track Fee"), billed on a per-number basis. Where applicable, the Fast Track Fee will be disclosed in the Contiguity Console or API documentation at the time of enablement.
5.2 Billing Without a Service Contract
If you are not enrolled in a Service Contract, the Fast Track Fee (if any) is billed monthly in advance on the first day of each billing cycle, alongside the Base Rate and applicable capability add-ons for the number.
5.3 Billing Under a Service Contract
If you are enrolled in a Service Contract, the Fast Track Fee (if any) is included in and applied against your fixed monthly fee amount, in accordance with the Contiguity Enterprise Service Contract Terms.
5.4 Non-Refundable
Fast Track Fees are non-refundable except as required by applicable law or as otherwise expressly stated in the Contiguity Services Agreement.
5.5 Fee Changes
Contiguity may introduce, modify, or discontinue the Fast Track Fee at any time upon 30 days' notice in accordance with Section 4.1 of the General Terms. Continued use of Fast Track following notice of a fee change constitutes your acceptance of the updated fee.
6. Modifications and Availability
Contiguity may modify, suspend, or discontinue Fast Track, in whole or in part, at any time and for any reason, in accordance with Section 2.3 of the General Terms. Contiguity will not be liable to you for any such modification, suspension, or discontinuation.
7. Relationship to Other Terms
7.1 Incorporation
These Fast Track Terms are incorporated into and made part of the Contiguity Services Agreement. All capitalized terms not defined in these Fast Track Terms have the meanings given to them in the Contiguity Services Agreement or the Contiguity Number Leasing Terms, as applicable.
7.2 Order of Precedence
In the event of a conflict between these Fast Track Terms and the General Terms, the Contiguity Number Leasing Terms, or any other Product Terms, these Fast Track Terms control solely with respect to the Fast Track feature. For any matter not addressed in these Fast Track Terms, the Contiguity Number Leasing Terms and General Terms govern.
7.3 Modifications
Contiguity may modify these Fast Track Terms at any time in accordance with Section 13 of the General Terms. Continued use of Fast Track after any modification constitutes acceptance of the modified Fast Track Terms.
